Helping Clients Navigate The Workers’ Compensation Application & Appeals Process
In every industry in the United States, thousands of workers are hurt on the job every year. Accidents can be as simple as a slip and fall on spilled water or as complex as a scaffolding collapse, but the result is the same – employees who are seriously injured.
In New York, employers are required to purchase a workers’ compensation insurance policy to protect their employee’s financial interests. This insurance is meant to cover the medical treatments that are associated with the work injury and may even provide a small portion of the worker’s wages if their injury prevents them from returning to work for an extended period of time. The insurance is supposed to be no fault meaning that even if the injured employee’s actions contributed to the accident, they are still covered, however, insurance companies still have a long list of reasons for denying a claim outright or reducing the amount that is paid. They’ve also made the process of filing a claim deliberately difficult.
When someone is suffering physically, mentally, and emotionally due to an injury, navigating the workers’ compensation process is just added stress. That’s why the legal team at Markhoff & Mittman have dedicated their careers to helping injured workers. From the very beginning, we provide the legal services that are needed, handle the paperwork, and talk to the insurance company.

Nursing & Healthcare Accidents Can End A Career
Attorneys Who Understand The Demands Of The Healthcare Industry
Law Firm Dedicated To Helping Nurses, Doctors, and Hospital Workers Get Workers’ Comp
Previously Provided Legal Services To Victims Of Slip & Fall Accidents, Negligent Security, Exposure, & Heavy Lifting
Unless one has been in the hospital or works in the healthcare industry, it can be difficult to understand the numerous hazards that healthcare workers are exposed to every single day. However, healthcare workers know that at any moment they could sustain an injury or be exposed to an illness that could keep them from their chosen career for a long period of time or for the rest of their lives.
Not only do healthcare workers have to dodge spilled liquids, lift large patients and supplies, and navigate large hospitals that may not be well maintained, but they often have to deal with disoriented and confused patients who may become violent and they are frequently exposed to contagious diseases and hazardous materials.
While it is possible to obtain workers’ compensation to cover the medical bills, a large number of these claims are denied. Denials may occur because of mistakes made on a claim form, insufficient records, or, as it often happens in the healthcare field, an employer contests the claim. Frequently, employers will claim that the injury didn’t occur on the job but in fact, took place while the employee was on their own time.
Fighting these denials can be difficult and are best done with the assistance of an attorney.

New York Legal Assistance Given During The Claims Process
While many injured workers are aware of how they can obtain compensation through workers’ comp, they don’t know that in many cases they are eligible to obtain compensation via other legal claims. These claims may include a Social Security Disability claim or a personal injury lawsuit.
The compensation provided through either of these claims can give an injured worker additional compensation for their lost wages, physical pain and suffering, and emotional trauma. But just like workers’ comp, the process of filing is intricate and any small mistake can result in a denial. While appeals are possible, there is a backlog and it can take more than a year for compensation to finally be obtained.
The best way to ensure a good outcome is to work with a legal firm from the very beginning. Markhoff & Mittman are able to assist clients with all types of claims and offer free consultations.

Construction Accident Victims Frequently Need A Lawyer Due To A Third-Party’s Negligence
Compensation Successfully Obtained For Hundreds Of Construction Accident Victims
Law Firm Dedicated To Helping New York Workers For More Than 70 Years
Free Consultations Offered For Victims
When an employer follows the law and obtains workers’ compensation coverage for their employees, the coverage prevents injured workers from filing a lawsuit against their employer. However, that doesn’t mean that a personal injury lawsuit or construction accident lawsuit isn’t possible. In many cases, a third-party, such as a contractor or parts manufacturer has been negligent and can be held responsible.
The purpose of filing a lawsuit is to provide the plaintiff with compensation that can cover medical expenses, lost wages, emotional suffering, and physical trauma. If the victim has passed away, their loved ones are frequently eligible to file on their behalf. In cases of wrongful death, loved ones may be able to regain compensation for their loss of consortium, loss of inheritance, and funeral and burial expenses.
These claims can be filed at the same time as workers’ compensation and social security disability claims.
