If you are injured while working in New York, the Maximum Benefit you can now receive as of July 1, 2013 is $803.21. Each year the Average Weekly Wage as it is known, changes based on the NY Department of Labor’s State Average Weekly Wage — you can receive two-thirds of your personal average weekly wage, up to $803.21.

For example, if you earn $1204.81 a week or more ($62K a year) then the most you can get is $803.21. Just a few short years ago, before 2007 you could ONLY get $400.00.

So if you are injured on the job here in the Empire State hopefully the weekly compensation benefit will help you get by until you are healthy enough to get back to work. See all of the New York Workers Compensation Rates.
