Now that NIOSH has added an additional 50 cancers to its list of related 9/11 illnesses, there could be thousands more applications for claims against the Zadroga Act. This stands to lessen the amounts some victims receive in compensation.
Those who have been diagnosed with a related cancer can begin receiving free treatment 30 days following the posting of the rule in the Federal Register. The special master of the Victims Compensation Fund, Sheila Birnbaum stated her office will make payments from the fund according to the latest rule. All Zadroga claims will be evaluated and will offset lost wage awards and compensatory damages through funds collected by workers compensation claims and other benefits like Social Security.
The proposal to expand the fund and keep it running for victims has been mentioned around Congress. Some supporters expect a bill to be filed shortly and many victims of the 9/11 fallout have been hoping legislators in New York will back up their case.
The additional cancers added to the compensation list include 14 main categories which include: cancer of the lip, tongue, salivary gland; cancer of the larynx, cancer of the nose, cancer of the esophagus, stomach, colon, rectum, liver; lung cancers; mesothelioma, breast cancer; cancer of the bladder, kidney, pelvis, and urinary organs; skin cancer; cancer of the eyes; thyroid cancer; blood cancers; and some rare cancers of childhood.
