Do I need a Manhattan workers comp lawyer for my case?
Not every case requires an attorney. If your injury was minor, your employer accepted the claim, and you’re back at work full-duty — you may not need one. But if your benefits got delayed, denied, or cut off, if you’re facing a hearing, if you’re being scheduled for an IME, or if a Section 32 settlement is on the table — you need a lawyer. How long do I have to file a workers’ comp claim in New York?
Two years from the date of injury, or two years from the date you knew or should have known the injury was work-related (for cumulative injuries like repetitive-strain). But you also have to notify your employer within 30 days. Waiting weakens your case — call us early.
What if my Manhattan employer doesn’t have workers compensation insurance?
Almost every NY employer is legally required to carry WC insurance. If yours doesn’t, you can still file a claim — through the NY State Uninsured Employers’ Fund — and you may also have grounds to sue the employer directly, which is normally barred under WC’s exclusive-remedy rule.
