The SSDI offset is one of the most misunderstood features of employer-sponsored LTD plans, and it is almost universal in group policies. Here is the mechanics: suppose your LTD policy pays $5,000 per month and you are later awarded $2,200 in SSDI. The insurer will reduce your LTD check to $2,800 — keeping the combined total at $5,000. You are not richer; the insurer simply shifts its cost obligation onto the Social Security system.
Most plans also require you to apply for SSDI as a condition of receiving LTD benefits, and some will pursue reimbursement (“overpayment recovery”) if you receive a retroactive SSDI lump sum that covers a period for which the insurer already paid full LTD. You may suddenly owe the insurer thousands of dollars from an SSDI back-payment you expected to keep.
Courts in the Second Circuit have consistently upheld offset provisions as valid plan terms under ERISA’s broad pre-emption of state law. Hinkamp v. American States Insurance Co. illustrates how aggressively insurers enforce these clauses.
