Can I get workers’ comp benefits if I had a pre-existing condition?

Having a pre-existing condition does not disqualify you from Workers’ Compensation in New York. The law uses the “aggravation rule” — if your work duties or a specific workplace accident made a pre-existing condition worse, that worsening is compensable as a workers’ comp injury.

Courts in New York follow the principle that employers take workers as they find them. A worker with a bad back who further injures it lifting boxes at work is entitled to benefits for the additional injury caused by work, even though the back was not perfect before.

The key legal question is whether work was a contributing cause of your current disability. It does not have to be the only cause — just a meaningful contributing factor. Medical evidence from your treating doctor explaining how work aggravated the pre-existing condition is essential.

Where pre-existing conditions get complicated: the insurer will use your prior medical history to argue that your current disability is entirely from the old condition, not from any work injury. They will dig into your prior medical records, prior WC claims, and prior treatment to build this argument. Your doctor needs to draw a clear line between your baseline before the accident and your condition after it.

Apportionment can also apply — under NY Workers’ Comp Law §15(8), the Special Fund for Reopened Cases (formerly the Second Injury Fund) may absorb some of the liability for pre-existing conditions in qualifying cases. This is a technical area that requires careful handling.
