Can I collect workers’ comp and Social Security Disability (SSDI) at the same time?
What you need to know
You can receive both Workers’ Compensation and Social Security Disability Insurance at the same time, but federal law caps the combined amount. Under 42 U.S.C. §424a, the SSA applies a “Workers’ Compensation offset” when your combined monthly income from both programs exceeds 80% of your highest average current earnings before the disability.
Here is how the math works in practice. Suppose your pre-injury average monthly earnings were $5,000. Eighty percent of that is $4,000. If your WC weekly benefit plus your SSDI monthly payment would total more than $4,000 a month, the SSA reduces your SSDI check to bring the combined total down to that $4,000 ceiling.
The offset ends when you reach full retirement age — currently 67 for most workers — at which point your SSDI converts to regular Social Security retirement benefits, and the offset no longer applies.
There is a planning opportunity here. A Section 32 lump-sum WC settlement can be structured — with proper legal language — to reduce or eliminate the SSA offset going forward. The settlement agreement must specifically allocate the lump sum over your expected life, and the language matters enormously. A poorly worded settlement can cost you thousands of dollars in lost SSDI benefits.
The timing of your SSDI application also matters. Filing SSDI too early or too late relative to your WC case can create coordination problems. Both claims need to be managed together, not separately.
