The short version

We collect what you send us and what your browser reports, and we use it to evaluate and respond to your inquiry. We do not sell, rent, or trade your personal information. Contact-form data for matters that did not result in an engagement is deleted after two years. Anything you send before an engagement is signed is not protected by attorney-client privilege.

This Privacy Policy describes how Markhoff & Mittman, P.C. (“the Firm,” “we,” “us,” or “our”) collects, uses, and protects information gathered through thedisabilityguys.com (the “Website”). This policy was last updated on May 14, 2026.

1. Information We Collect

We collect information in the following ways:

a. Information You Provide Directly

When you submit a contact form, request a consultation, or send us an email, you may provide: your name, telephone number, email address, a description of your legal matter, and your preferred language. This information is used solely to evaluate and respond to your inquiry.

b. Automatically Collected Information

When you visit the Website, we automatically collect: your IP address, browser type and version, operating system, referring URL, pages visited, and date and time of access. This information is collected through server logs and analytics tools (see Section 3).

c. Cookies and Similar Technologies

The Website uses cookies — small text files placed on your device — for the following purposes: (i) essential operation of the website (session management); (ii) analytics to understand aggregate usage patterns; and (iii) remembering language preference (English or Spanish). We do not use cookies for cross-site behavioral advertising. You may disable cookies through your browser settings, though some website functionality may be affected.

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry or consultation request
  • Evaluate whether an attorney-client relationship is appropriate
  • Communicate with you about your case, if an engagement is established
  • Improve the content, structure, and functionality of the Website
  • Comply with legal and regulatory obligations

We do not use your personal information for automated decision-making or profiling that produces legal effects.

3. Analytics

This Website uses third-party analytics services (including Google Analytics) to collect and analyze aggregate data about how visitors use the Website. These services may use cookies and similar tracking technologies. The data collected is aggregated and anonymized to the extent technically feasible and is used only to improve website performance. We do not share individually identifiable analytics data with third parties for their independent use.

You may opt out of Google Analytics data collection by installing the Google Analytics Opt-Out Browser Add-on.

4. Attorney-Client Privilege and Confidentiality

Information you submit through the Website prior to the formation of an attorney-client relationship is not protected by attorney-client privilege. Do not submit confidential, sensitive, or privileged information through a contact form or general email until you have been notified in writing that an engagement has been established.

Once an attorney-client relationship is formed through a signed engagement letter, communications between you and the Firm are protected by attorney-client privilege and by the New York Rules of Professional Conduct, Rule 1.6 (Confidentiality of Information).

5. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties. We may share information only in the following limited circumstances:

  • Service providers: Vendors who assist with website hosting, email delivery, and analytics, subject to confidentiality obligations and prohibited from using your data for their own purposes.
  • Legal requirements: When disclosure is required by law, court order, or governmental authority.
  • Referral counsel: With your explicit consent, when we determine that a specialist in another area will achieve a better result for you and we refer your matter with your knowledge.

6. Data Retention

Inquiry and contact form data for matters that did not result in an engagement is retained for a maximum of two (2) years for conflict-check purposes, then permanently deleted. Records related to active or closed client matters are retained in accordance with New York State recordkeeping requirements for legal matters (generally a minimum of seven years post-closure). Analytics data is retained in aggregated form and is not linked to individual identities after 26 months.

7. Your Rights

You have the following rights with respect to your personal information:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate information.
  • Deletion: Request deletion of your personal information, subject to legal retention requirements.
  • Portability: Request your data in a structured, commonly used, machine-readable format where technically feasible.

8. New York SHIELD Act

The Firm complies with the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information of New York residents against unauthorized access, use, modification, or disclosure. In the event of a data breach affecting your personal information, we will notify affected individuals as required by New York law.
