In New York auto accident cases, you can’t sue for pain and suffering unless your injury meets the “serious injury threshold” of Insurance Law §5102(d) — death, dismemberment, significant disfigurement, fracture, loss of a fetus, permanent loss of an organ, permanent or significant limitation, or non-permanent injury preventing usual activities for 90 of 180 days. We evaluate threshold from day one.

What if I was partially at fault for the accident in Manhattan?

New York follows “pure comparative negligence” — even if you were partially at fault, you can recover damages reduced by your fault percentage. If you were 30% at fault on $100,000 in damages, you can recover $70,000. Most cases are less clear-cut than the insurance company suggests.
