Do I Have to see the Insurance Company Doctor?

Hello, I’m New York disability attorney, Brian Mittman. A commonly asked question that I get is, “Do I have to see the insurance company doctor?”  First things first; in New York, you’re entitled to treat with your own doctor.  However, the insurance company is allowed to have you examined from time to time with an examination known as “Independent Medical Exam” or IME.

After all these years of doing this, there’s usually nothing independent and sometimes nothing medical or even an exam about those exams.  However, you have to go to these exams; otherwise, you can be denied benefits and denied treatment.
