Injuries: Three Right Shoulder Injuries (with surgery)
What Happened?
Our client, a building handyman and 32BJ Union member, suffered a serious injury to his right shoulder while lifting and swinging heavy garbage bags into a dumpster. He reported the injury but did not see a doctor for some time. The condition got worse, and he sought some treatment but did not lose time from work. Shortly after, he further injured his shoulder while using a gas-powered leaf blower. This time he sought medical attention right away. However, he only missed a few days from work and returned. Only to slip and fall in the basement on the same shoulder. While the insurance company (which was the same for all three cases) accepted each case, there were disputes over his right to lost time, which incident should pay for medical care and if he had a permanent injury.
The Results 💪
At The Disability Guys, we got to work! We were able to secure medical evidence showing that he had a permanent injury as a result of all three accidents (he did have surgery!). Also, since there was minimal lost time we sought a money award for the permanent injury and we recovered $45,000.00 even though the Insurance company only offered $10,000.00.
