Are the new NY workers’ comp medical treatment guidelines a DISGRACE?

As you may already be aware, the New York Workers’ Comp Board (WCB) has made change to their medical treatment guidelines for neck, mid/lower back, shoulder and knee injuries.  Change is good, right?


Not so fast.  The sheer number of guidelines that must be followed – and the resulting confusion that has the WCB offering over 70 answers to frequently asked questions on their website – is a symptom that institutional insanity has taken over.  Instead of making guidelines clearer and easier to follow for doctors, insurers and injured NY workers, the new system is like a bureaucracy within a bureaucracy within a bureaucracy.  And that isn’t good for anyone – except the bureaucrats!


We can appreciate that the WCB is trying to do good here, but they’ve gone and tied themselves in knots doing it.  We do need clear guidelines explaining how injured workers should be treated.  We do need to prevent unscrupulous insurance companies from denying injured workers the treatment they need.  And we do need to help workers get better and return to work.  But the system should not be this difficult to understand!
