For instance, if you are a passenger in a motor vehicle owned by your employer and injured while working can you sue somebody?  The answer of course is it depends.  You can actually sue the person that hit you but you cannot sue the person that’s driving the car since they’re your coworker.  However, if your employer also has what’s called uninsured or under insured motorist you may be able to make a claim against that policy which is separate from your workers’ compensation claim and separate from any lawsuit.  What you really need to do is gather all the facts and speak to a professional to figure out if you might have a claim beyond just workers’ compensation.  For more information about this or any other workers’ compensation topics get our free reports (click on the report on the right side) or call us.
