NY Construction Workers: Do You Deserve More Than Just Workers’ Comp Benefits After an On-the-job Injury?

Construction work is one of the most dangerous jobs in New York, and every year construction workers are hurt or killed through no fault of their own.  To protect injured workers there is a workers’ compensation insurance system in place in New York, to ensure that workers are not left without medical care and other benefits while they recover from a workplace accident.

 

In some cases, injured workers may be eligible for more than just the benefits provided by their employer’s workers’ comp insurance.  If you or someone you love has been injured in a construction accident in New York that involved a scaffold, ladder, hoists, ropes or similar equipment, then you need to know that you may be entitled to more than just workers’ comp benefits.

 

Labor Law Section 240, also known as the “scaffold law”, makes provisions for workers who work with scaffolds, ladders, ropes, hoists or other similar types of equipment.  What does this law mean to you as an injured worker in New York?

 

Any property owner or contractor with whom you work is required to make sure that scaffolds, hoists, ropes, stays, ladders, hangers, slings, pulleys, blocks, braces, irons and other similar devices are safe for use and that the appropriate safety equipment is also in place so workers are not injured in falls from high places (so called “elevation hazards).
