Former Beautician Involved in a Motor Vehicle Accident

SUMMARY:  Claimant sustained a motor vehicle accident in 2009, which resulted in serious injuries to her right shoulder, lower back and right knee. Although she returned to work after the car accident, her physical injuries prevented her from standing for long periods or using her right arm (dominant arm) to work as a beautician. The claimant alleged disability starting from the date of her motor vehicle accident, but due to significant work after the accident, a finding of disability was more appropriate on the day she stopped working due to her injuries, which was about a year after the accident. At the hearing and with consent of the claimant, we amended the claimant’s onset date to

AGE:  56

PAST WORK:  beautician

INJURIES:  right shoulder rotator cuff tear, chronic lower back pain, right knee meniscal tear

INITIAL DECISION: DENIED

HEARING LEVEL RESULT: FULLY FAVORABLE decision with amended onset date to when the claimant stopped working.

DISCLAIMER: The results are specific to the facts and legal circumstances of each of the clients’ cases and should not be used to form an expectation that the same results could be obtained for other clients in similar matters without reference to the specific factual and legal circumstances of each client’s case.
